Subcommittees
The Litigation Committee has set up a number of sub-committees to concentrate on key areas of its responsibilities.
Litigation Committee – UPC
UPC Sub-Committee remits:
- Receives input from the Executive Group on discussions at the UPC Registrar & IT Team and UPC Administrative Committee meetings;
- Monitors the secondary legislation of the UPC (e.g. UPC Rules of Procedure (RoP) and PMAC Rules on Mediation and Arbitration);
- Monitors developments of the UPC CMS;
- Studies and reports on UPC case-law; and
- Studies, discusses and reports on enforcement of UPC decisions and orders (Art. 82 UPCA, Rule 352 & 354 RoP) in cooperation with the National Litigation Matters Sub-committee.

Litigation Committee – National Litigation Matters
National Litigation Matters Sub-Committee remits:
- Studies, discusses and reports on enforcement of national decisions;
- Studies, discusses and reports on developments in national patent litigation related legislation;
- Carries out surveys regarding national practice in patent litigation, e.g. costs/cost recovery in national revocation proceedings; limited revocation attacks on individual claims only;
- Studies, discusses and reports on interplay between national proceedings and UPC proceedings, e.g. national inspection proceedings as basis for UPC infringement action; and
- Studies, discusses and reports on enforcement of UPC decisions and orders (Art. 82 UPCA, Rule 352 & 354 RoP) in cooperation with the UPC Sub-committee.

Litigation Committee – EU and International Litigation Matters
EU and International Matters Sub-committee remits:
- Receives input from the Executive Group on international discussions on Client-Patent attorney privilege before Group B+ and the WIPO Standing Committee on the Law of Patents (SCP);
- Monitors developments on EU and international patent litigation matters;
- including policy developments and interstate agreements in so far as they impact patent litigation topics;
- Monitors developments on the practical frameworks for conducting patent litigation in EU and internationally;
- Studies, discusses and reports on relevant EU and international patent litigation topics; and
- Cooperates with other epi committees to discuss and prepare position papers on behalf of epi on matters concerning patent litigation.
