Proposal for a Code of Conduct for the UPC

According to Rule 290(2) of (the 18th draft of) the Rules of Procedure of the Unified Patent Court (“RoP UPC”), representatives who appear before the Court shall strictly comply with any code of conduct adopted for such representatives by the Administrative Committee. European Patent Attorneys with specific qualifications will be able to represent parties before the UPC under Article 48(2) of the Agreement on a Unified Patent Court.

The draft Code of Conduct{target=_blank}, as referred to in the RoP UPC, has been under preparation for some time within EPLAW, EPLIT and epi. It was discussed in the 3rd UPC Expert Panel Meeting in Paris on September 18th, 2015. Valuable feedback was received and incorporated. Furthermore, our associations are very pleased with the various proposals for improvements suggested by experts in particular from IPLA and CCBE during the last months. In the coming weeks, EPLAW, EPLIT and epi will continue discussing the draft with interested parties to reach broad consensus on its contents.
