Council remembers Terry Johnson and Francisco Bernardo Noriega, and discusses the latest EPO developments with EPO President

**epi **C91 Council meeting took place on 13 November 2021 by videoconference. A total of 188 participants attended the meeting.

In a <a href=“https://www.epo.org/law-practice/legal-texts/official-journal/2021/10/a79.html”target=“_blank“>notice from the EPO dated 22 October 2021 the EPO announced that it is now possible to obtain EPO badges for professional representatives by a pre-arranged video call.

In a <a href=“https://www.epo.org/law-practice/case-law-appeals/recent/t180116ex1.html”target=“_blank“>decision of the Board of Appeal in case T 0116/18, three questions have been referred to the Enlarged Board concerning how to regard post-published evidence filed in support of inventive step.
The referral is pending under G 2/21.

The EPO has taken measures to process the backlog in entries on the List of Professional Representatives. As announced on the <a href=“https://www.epo.org/applying/online-services/representatives/request.html”target=“_blank“>EPO website, all pending entry requests will be dealt with by calendar week 41 of 2021 (which starts today).

As reported in the latest issue of <a href=“https://information.patentepi.org/issue-3-2021/progress-on-upc-ratification-in-germany.html”target=“_blank“>epi Information, the German Federal President recently signed the ratification law of both the UPC Agreement and the Protocol on Provisional Application (“PPA”), which was published in the Federal Law Gazette on 12 August 2021.
