The Boards of Appeal have published a communication setting a deadline of 27 April 2021 for any third party wishing to make a written statement (or amicus curiae) under Article 10(1) of the Rules of Procedure of the Enlarged Board of Appeal in relation to the question referred in G 1/21.

Article 15a RPBA was approved by the Administrative Council of the European Patent Organisation at its 166th meeting on 23 March 2021. It had previously been adopted by the Boards of Appeal Committee (BOAC) on 11 December 2020. The BOAC plans to consult users in due course to assess their experience with it.
The Enlarged Board of Appeal of the EPO published its decision G 1/19 on computer-implemented simulations on 1 March 2021. The Enlarged Board of Appeal considered that computer invented simulations must be assessed according to the same criteria as any other computer-implemented invention.
