G 1/21 - Oral Proceedings by Videoconference – Amicus Curiae Deadline of 27 April 2021

The Boards of Appeal have published a communication setting a deadline of 27 April 2021 for any third party wishing to make a written statement (or amicus curiae) under Article 10(1) of the Rules of Procedure of the Enlarged Board of Appeal in relation to the question referred in G 1/21.

The question referred to the Enlarged Board of Appeal in G 1/21 is:

“Is the conduct of oral proceedings in the form of a videoconference compatible with the right to oral proceedings as enshrined in Article 116 (1) EPC if not all of the parties to the proceedings have given their consent to the conduct of oral proceedings in the form of a videoconference?”

Oral proceedings before the Enlarged Board will be held by videoconference via Zoom on 28 May 2021.
