As reported previously (see here) epi has raised concerns with the EPO that the implementation, as of 1st July 2022, of Standard ST 26 on sequence listings might impose an undue burden on applicants and trigger added matter issues.
In its decision J 8/20 of 5 July 2022 the Legal Board of Appeal confirmed that under the European Patent Convention an inventor designated in a patent application must be a human being.
